Melts LLC – Comprehensive Terms of Use and Agreement for Registered Affiliates
This Affiliate Agreement (“Agreement”) is entered into by and between Melts LLC (“Melts™,” “Company,” “we,” or “us”) and the approved applicant (“Affiliate,” “you,” or “your”). By submitting an affiliate application, promoting Melts™ products, or sharing affiliate links, you confirm your full acceptance of this Agreement.
1. Application and Approval
1.1 No Guarantee of Acceptance
Submitting an application does not guarantee approval. Melts™ may approve or reject any application for any reason, at its sole discretion and without explanation.
1.2 Brand Alignment
Approval is based on brand fit, platform quality, audience alignment, content history, and compliance posture.
1.3 Right to Reevaluate
Melts™ may reevaluate eligibility at any time and suspend or terminate approval if alignment changes at anytime for any reason.
2. Independent Contractor Status
2.1 You are an independent contractor, not an employee, partner, joint venturer, or agent of Melts™.
2.2 You have no authority to bind the Company or represent yourself as acting on behalf of Melts™ beyond basic promotional capacity.
3. Affiliate Obligations
3.1 Good-Faith Marketing Requirement
If you accept sample or promotional product from Melts™, you agree that such acceptance creates a good-faith obligation to promote, recommend, share, and create brand-positive exposure through posts, marketing, content, and/or referrals.
3.2 Brand Representation
You may not:
- Disparage, defame, or undermine the brand
- Present Melts™ in a misleading, hostile, or negative way
- Publish messaging contrary to brand positioning or values
3.3 Regulatory Compliance
You must comply with:
- FTC endorsement and disclosure rules
- FDA guidance on structure/function claims
- State and federal advertising laws
- No unapproved medical claims, disease claims, “cure” statements, or exploitation of wellness fears or vulnerabilities
3.4 Responsibility for Statements
You are solely responsible for all claims, content, or messaging you publish. You assume liability for your statements and agree to hold Melts™ harmless from all regulatory inquiries or claims arising from your marketing.
3.5 Posting Frequency and Marketing Obligationsments
To remain in good standing within the Affiliate Program, the Affiliate agrees to meet the following monthly posting minimums:

| Short-form Video (Reel / TikTok) | 1–2 per month | Engaging, informative, or testimonial-style video content |
| Affiliate Code / Link Mentions | Every 1–2 weeks | Inclusion of affiliate link or discount code in caption, bio, or story |
3.6 Content Guidelines
In addition to all other terms herein, you explicitly agree to remain compliant with these and other guidelines:
- All posts must comply with FTC disclosure requirements (e.g., “#ad” or “#partner” tags).
- Content must align with the brand’s values: wellness, authenticity, and transparency.
- Affiliates should only represent the products in a positive and accurate manner.
4. Affiliate Conduct Restrictions
You may NOT:
- Advertise on illegal or inappropriate websites
- Use spam, unsolicited email, or automated traffic
- Bid on keywords containing Melts™ trademarks without written permission
- Use deceptive coupon or deal claims
- Offer your own cash-back or rebate incentives from your commission
- Suggest affiliation implies medical outcomes or guarantees
5. Coupon & Deal Policy
Affiliates may only promote official, assigned coupons supplied by Melts™. Use of unauthorized coupons, “fake deals,” or coupon SEO baiting is prohibited.
6. Pay-Per-Click (PPC) Policy
PPC bidding on “Melts,” “GetMelts,” or brand variations is not permitted without prior written approval.
7. Commissions and Payment
7.1 Qualification
Commissions are earned on valid, fully-paid, non-refunded customer orders using your affiliate link.
7.2 Refund Window
Because Melts™ offers a 30-day refund guarantee, payouts are released 15 days after the refund period closes, approximately 45 days after customer delivery.
7.3 Chargebacks & Fraud
Orders that are refunded, reversed, or fraudulent are not commissionable.
7.4 Pending Commissions at Termination
If this Agreement terminates, earned commissions on valid prior orders will still be paid on schedule.
8. Termination
8.1 At-Will
Either party may terminate at any time, with or without cause.
8.2 Immediate Termination Grounds include:
- Disparaging or damaging statements about Melts™
- False medical claims
- FTC/FDA violations
- Misuse of trademarks or brand assets
- Coupon fraud / PPC violations
- Spam or deceptive promotion
9. Intellectual Property
9.1 All logos, trademarks, product names, images, and promotional assets remain the property of Melts LLC. Use is granted on a revocable, non-exclusive basis only during active participation.
9.2 All content created by the Affiliate remains the property of its creator, notwithstanding; Melts™ retains a permanent, non-revocable and perpetual royalty-free license to repost, share, or use the content across digital channels for marketing and advertising purposes with credit to the creator without limitation and throughout the Universe.
10. Limitation of Liability
Melts™ is not liable for incidental, indirect, punitive, or consequential damages arising from your affiliate participation. Your exclusive remedy is commissions owed per this Agreement.
11. Indemnification / Hold Harmless
You agree to indemnify and hold harmless Melts LLC, its owners, managers, officers, employees, and representatives from any and all claims, damages, regulatory actions, or liabilities arising from your marketing content, messaging, conduct, statements, or violation of law.
12. Modifications
Melts™ may modify these terms at any time. Continued participation constitutes acceptance of revisions.
13. Entire Agreement
This Agreement supersedes all prior discussions or communications and constitutes the full and final understanding between the parties.
By applying to and/or participating in the Melts™ Affiliate Program, you acknowledge and agree to all terms contained herein, including compliance with advertising regulations and brand-protection requirements.
